Partner Visa
The Partner Visa allows spouses or de facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens to live in Australia permanently. This visa provides a pathway to permanent residency, enabling couples to reunite and build their future together in Australia.
There are two stages in the Partner Visa process:
- Temporary Partner Visa (Subclass 820/309): Grants temporary residency while the permanent visa is being processed.
- Permanent Partner Visa (Subclass 801/100): Granted after two years if the relationship remains genuine and ongoing.
Applicants must provide proof of their genuine relationship, including financial, social, and household evidence. The visa allows holders to live, work, and study in Australia while accessing Medicare and other benefits.
What are the different types of Partner Visas?

Offshore Partner Visa (Subclass 309 & 100): Applied for outside Australia.

How long does it take to process a Partner Visa?
Processing times vary, but generally:
Temporary Partner Visa: 12 to 24 months
Permanent Partner Visa: Additional 2 years after holding the temporary visa

Can I work in Australia on a Partner Visa?
Yes, once granted a Temporary Partner Visa (Subclass 820/309), you can live, work, and study in Australia while waiting for the permanent visa.
What proof do I need to show for a Partner Visa?
You must provide relationship evidence, including joint finances, shared household responsibilities, social recognition, and communication records.
Can I include my children in my Partner Visa application?
Yes, dependent children can be included in your application and will receive the same visa benefits.
Do I need to marry my partner to apply for a Partner Visa?
No, de facto partners can also apply, provided they have been in a committed relationship for at least 12 months before applying.
What happens if my relationship ends before my visa is granted?
If your relationship breaks down before obtaining permanent residency, you must notify immigration. Some exceptions allow visa continuation, such as domestic violence cases or having shared children.
